These Terms and Conditions ("Terms") govern your use of the services provided by Email Migration Hub ("we", "us", "our") at emailmigrationhub.com. By using our services, you agree to these Terms in full. If you do not agree, you must not use our services.
Email Migration Hub is operated by a sole trader based in the United Kingdom.
1. Our Services
Email Migration Hub provides the following services:
- Email Migration: Transfer emails between email accounts using IMAP or Exchange protocols.
- Cloud-to-Cloud File Transfer: Transfer files between cloud storage providers, including Google Drive, Dropbox, and OneDrive.
- Large File Sending (Send): Upload and share large files (up to 25GB) with others via a download link, similar to WeTransfer.
2. Eligibility
You must be at least 18 years old to use our services. By using our services, you confirm that you are at least 18 and that the information you provide is accurate and complete.
3. Your Account
You are responsible for:
- Providing a valid, working email address when registering.
- Keeping your account credentials secure.
- All activity that occurs under your account.
You must notify us immediately at support@emailmigrationhub.com if you believe your account has been compromised.
4. Acceptable Use
You agree to use our services only for lawful purposes. You must not use our services to:
- Upload, transfer, or distribute any content that is illegal under UK or international law.
- Upload or distribute malware, viruses, trojans, ransomware, or any other malicious software.
- Upload or distribute copyrighted material without the permission of the copyright holder.
- Upload or distribute harmful, abusive, threatening, defamatory, or obscene images or content.
- Upload or distribute child sexual abuse material (CSAM). Any such activity will be reported to law enforcement immediately.
- Send unsolicited bulk email (spam) or use our service to facilitate phishing.
- Attempt to gain unauthorised access to our systems, other users' accounts, or third-party services.
- Interfere with or disrupt the operation of our services.
- Misrepresent your identity or impersonate another person.
5. Prohibited Content — Zero Tolerance
We operate a strict zero-tolerance policy on the following:
- Malware, viruses, or any form of malicious software.
- Illegal material of any kind.
- Harmful, abusive, or obscene images and content.
- Copyrighted material uploaded without the rights holder's permission.
Uploading any prohibited content will result in an immediate and permanent ban from all Email Migration Hub services. Your account will be terminated, any files will be deleted, and no refund will be issued. We reserve the right to report illegal activity to the relevant authorities.
6. Security Scanning
We reserve the right to scan all files uploaded to our services for viruses, malware, and other security threats using ClamAV. This scanning is performed automatically to protect our users and infrastructure. By using our services, you consent to this scanning.
If a file is found to contain malware or a virus, it will be quarantined or deleted, and your account may be suspended or permanently banned at our discretion.
7. File Storage and Deletion
- Send service: Files uploaded via our Send service are stored temporarily and automatically deleted after the expiry period you selected (between 7 and 30 days). Once deleted, files cannot be recovered.
- Cloud transfers: Files transferred between cloud services are streamed through our server and are not stored on our infrastructure.
- Email migration: Email data passes through our server during migration and is not stored. Credentials are discarded immediately after the migration completes.
We are not a backup or long-term storage service. You are responsible for maintaining your own copies of your data.
8. Payments
- All payments are processed securely through PayPal. We do not collect, store, or have access to your credit or debit card details.
- Payments are one-time charges for the service purchased. There are no recurring subscriptions unless explicitly stated.
- Prices are displayed on our website and may change at any time. The price at the time of purchase applies to your order.
- All prices are inclusive of VAT where applicable.
9. Refund Policy
- Service completed successfully: No refund is available once a migration or transfer has been completed successfully.
- Service failed due to our technical issue: If a migration or transfer fails due to a fault on our side and we are unable to resolve it, you are entitled to a full refund. Contact us at support@emailmigrationhub.com with details of the issue.
- Service failed due to incorrect credentials or user error: We will make reasonable efforts to help you resolve the issue, but a refund is not guaranteed in cases where the failure is not attributable to our service.
- Banned accounts: No refund will be issued if your account is terminated for violating these Terms.
Refund requests must be made within 14 days of the original transaction.
10. Intellectual Property
All content on emailmigrationhub.com, including text, graphics, logos, and software, is the property of Email Migration Hub or its licensors and is protected by UK and international copyright law. You may not reproduce, distribute, or create derivative works from our content without our written permission.
You retain ownership of all data and files you upload or transfer through our services.
11. Service Availability
We aim to keep our services available at all times, but we do not guarantee uninterrupted or error-free operation. Our services are provided on a "best effort" basis. We may need to temporarily suspend services for:
- Scheduled maintenance.
- Emergency security updates.
- Circumstances beyond our reasonable control.
We do not offer a formal Service Level Agreement (SLA). We will make reasonable efforts to notify users of planned downtime where possible.
12. Limitation of Liability
To the fullest extent permitted by law:
- Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
- We are not liable for any loss of data, loss of revenue, or business interruption resulting from the use of our services.
- Our total liability to you for any claim arising from the use of our services is limited to the amount you paid for the specific service that gave rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
13. Account Termination
We reserve the right to suspend or terminate your account at any time if:
- You breach these Terms.
- You upload prohibited content.
- You engage in abusive, fraudulent, or illegal activity.
- We reasonably believe your account poses a security risk.
Upon termination, your access to the service will be revoked and any files associated with your account may be deleted.
14. Third-Party Services
Our services integrate with third-party platforms (Google, Microsoft, Dropbox, PayPal). Your use of these platforms is governed by their respective terms and privacy policies. We are not responsible for the availability, security, or policies of third-party services.
15. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
